Welcome to Singair Mart. These Terms & Conditions (“Terms”) govern your access to and use of the Singair Mart website, mobile-optimised web experience and related services (collectively, the “Platform”), operated from Singair, Manikganj, Dhaka Division, Bangladesh (“Singair Mart”, “we”, “us” or “our”). Please read these Terms carefully before using the Platform. By accessing, browsing, registering on or purchasing from the Platform, you confirm that you have read, understood and agreed to be bound by these Terms and by every policy referred to in them, including our Privacy Policy, Return & Refund Policy, Shipping & Delivery Policy, Buyer Protection Policy, Cookie Policy, Intellectual Property Policy, Prohibited & Restricted Products Policy and, where applicable, the Seller Terms & Conditions and the Seller Code of Conduct (together, the “Policies”). If you do not agree with any part of these Terms, you must not use the Platform.

1. Introduction and Acceptance of Terms

1.1. Singair Mart is a multi-vendor digital commerce marketplace within the meaning of the Digital Commerce Operation Guidelines, 2021 (ডিজিটাল কমার্স পরিচালনা নির্দেশিকা, ২০২১) issued by the Ministry of Commerce, Government of the People’s Republic of Bangladesh (as amended from time to time, the “Digital Commerce Guidelines”). The Platform enables independent third-party sellers (“Sellers” or “Vendors”) to list, market and sell products to customers (“Buyers”, “you”), and enables Buyers to browse, compare, order, pay for and track those products.

1.2. These Terms constitute a legally binding agreement between you and Singair Mart under the Contract Act, 1872 of Bangladesh. By clicking “Place Order”, creating an Account, or otherwise using the Platform, you signify assent in a manner recognised for electronic contracts under the Information and Communication Technology Act, 2006, and electronic records generated by the Platform (including order logs, timestamps, IP records and delivery confirmations) are admissible as evidence in accordance with the Evidence Act, 1872 as amended to recognise digital records.

1.3. These Terms apply to every visitor of the Platform, whether or not registered, and to every transaction concluded through the Platform. Additional terms apply to Sellers, as set out in the Seller Terms & Conditions; in the event of a conflict between these Terms and the Seller Terms & Conditions in respect of a Seller’s rights and obligations, the Seller Terms & Conditions prevail. In the event of a conflict between these Terms and a specific Policy in respect of the subject matter of that Policy, the specific Policy prevails.

1.4. We may present certain content, notices or customer communications in Bangla, in English, or in both languages. Where a Bangla text and an English text of the same notice differ, the version expressly designated as authoritative shall prevail; if no designation is made, the English version of these Terms prevails for interpretation purposes while statutory consumer rights under Bangladeshi law remain unaffected in either language.

1.5. If you use the Platform on behalf of a company, partnership, proprietorship or other organisation, you represent that you are authorised to bind that organisation, and “you” includes that organisation.

2. Definitions and Interpretation

2.1. In these Terms, unless the context requires otherwise:

“Account” means the registered user account created on the Platform, including Buyer accounts and Seller accounts;
“Applicable Law” means the laws of the People’s Republic of Bangladesh, including without limitation the Contract Act 1872, the Sale of Goods Act 1930, the Evidence Act 1872 (as amended), the Penal Code 1860, the Consumer Rights Protection Act 2009, the Information and Communication Technology Act 2006, the Cyber Security Act 2023, the Digital Commerce Operation Guidelines 2021, the Competition Act 2012, the Money Laundering Prevention Act 2012, the Value Added Tax and Supplementary Duty Act 2012, the Income Tax Act 2023, the Trademarks Act 2009, the Copyright Act 2000 (as amended), the Special Powers Act 1974 (in respect of counterfeiting and hoarding), and all rules, regulations, directives and guidelines made under them;
“Buyer” means any natural or legal person who browses the Platform or places an Order, whether as a registered customer or as a guest;
“Campaign” means a time-limited promotional event on the Platform, such as a flash sale, seasonal festival campaign or clearance event;
“COD” means Cash on Delivery, the payment method by which a Buyer pays the invoiced amount at the time of delivery;
“Content” means all text, images, photographs, product descriptions, reviews, questions, answers, ratings, graphics, logos, audio, video and other material available on or submitted to the Platform;
“Delivery Area” means a geographic area configured on the Platform for which a delivery charge or free-delivery threshold applies, currently including Singair Pourosova and areas outside Singair Pourosova, as may be updated from time to time;
“DNCRP” means the Directorate of National Consumer Rights Protection of Bangladesh (জাতীয় ভোক্তা অধিকার সংরক্ষণ অধিদপ্তর);
“MFS” means a mobile financial service licensed by Bangladesh Bank, such as bKash, Nagad or Rocket;
“Order” means a purchase request placed by a Buyer through the Platform’s checkout for one or more Products;
“Product” means any good listed for sale on the Platform by a Seller or by Singair Mart itself;
“Rider” means a delivery person engaged by Singair Mart or a Seller to deliver Orders to Buyers;
“Seller” / “Vendor” means a third party approved by Singair Mart to operate a store and sell Products on the Platform;
“Tracking Link” means the personal, tokenized link issued for each Order which displays the Order’s live delivery status;
“Working Day” means a day other than Friday, Saturday (where applicable to banking operations), or a public holiday in Bangladesh, provided that our own customer-service days are Saturday to Thursday as published on the Contact page.

2.2. In these Terms: headings are for convenience only and do not affect interpretation; “including” and “for example” are illustrative and not exhaustive; the singular includes the plural and vice versa; references to legislation include that legislation as amended, replaced or re-enacted; and references to a “clause” are to a clause of these Terms unless stated otherwise.

3. Eligibility, Registration and Guest Checkout

3.1. You may use the Platform only if you are capable of forming a legally binding contract under the Contract Act, 1872 — that is, you are at least 18 years of age and of sound mind, and not disqualified from contracting by any law to which you are subject. Persons under 18 may use the Platform only under the supervision and with the consent of a parent or legal guardian, who accepts these Terms on their behalf and remains fully responsible for their activity, Orders and payment obligations.

3.2. Registration. To register an Account, you must provide accurate, current and complete information — including your name, a valid Bangladeshi mobile number and a valid email address — and keep it updated. You must not impersonate another person, use another person’s identity documents, phone number or payment instrument without authority, or create an Account by automated means. We may verify the information you provide, including by one-time verification codes sent to your phone or email.

3.3. Guest checkout. You may place an Order without registering by providing your full name, phone number, email address, delivery area and full address at checkout. Guest Orders are subject to these Terms in the same way as Orders placed by registered users. Your guest details are used to fulfil the Order, issue your Tracking Link, and meet our record-keeping obligations.

3.4. Each person may maintain one Buyer Account unless we expressly permit otherwise. We may refuse registration, decline to offer the service, merge duplicate accounts, or close duplicate or fraudulent accounts at our discretion, subject to Applicable Law.

3.5. Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account. You must use a strong password, must not share credentials, and must notify us immediately at support@singairmart.com or +880 1761-234567 if you suspect unauthorised use. We are not liable for losses arising from your failure to keep credentials confidential, except where the loss is caused by our own negligence or security failure.

3.6. Accuracy of delivery data. You must ensure the accuracy of the recipient name, phone number, Delivery Area and address for every Order. Costs, failed deliveries and delays caused by incorrect or incomplete information are your responsibility. Where you order for delivery to a third person (for example, a gift), you confirm that you have that person’s consent to provide their contact details for delivery purposes.

4. Nature of the Marketplace; Role and Responsibilities of Singair Mart

4.1. Singair Mart operates the Platform as an intermediary marketplace. Unless a Product listing expressly identifies Singair Mart as the seller, the contract of sale for each Product is formed directly between the Buyer and the relevant Seller. Singair Mart is not a party to that contract of sale, does not take title to Seller Products, and acts as a facilitator providing the technology, catalogue, order management, payment coordination, order tracking, dispute-resolution assistance and, where applicable, delivery coordination through Riders.

4.2. Notwithstanding clause 4.1, Singair Mart accepts the responsibilities that the Digital Commerce Guidelines place on a marketplace operator, including:

4.3. Each Product page displays the name of the Seller’s store, and each store has a public storefront page. Order confirmations, invoices and the vendor dashboard identify which Seller is responsible for each item in a multi-seller Order. Where a single Order contains Products from more than one Seller, each Seller is responsible for its own items; delivery may be charged and performed separately for each Seller as shown at checkout, and items may arrive in separate parcels at different times.

4.4. Singair Mart does not manufacture the Products listed by Sellers and, except as stated in the Buyer Protection Policy, gives no independent warranty in respect of them. Manufacturer or Seller warranties, where offered, are stated on the Product page and are honoured by the party granting them.

4.5. We may, but are not obliged to, screen Sellers, verify trade licences and identity documents at onboarding, audit listings, mystery-shop, and monitor performance metrics (delivery success rate, return rate, review scores, response times). These measures support marketplace quality but do not make Singair Mart the seller of record for Seller Products.

5. Product Listings, Descriptions, Stock and Compatibility

5.1. Sellers are responsible for the accuracy, completeness and legality of their listings, including Product names, descriptions, images, specifications, prices, stock levels, country of origin, warranty statements, expiry dates for consumables, and any Bangla or English marketing text. Singair Mart reviews listings on a sample and complaint-driven basis and may edit, suppress or remove any listing that appears inaccurate, unlawful or in breach of the Prohibited & Restricted Products Policy.

5.2. Product images are for illustration. Actual colour, packaging and minor cosmetic details may vary due to photography, screen settings or manufacturer changes. Measurable characteristics (dimensions, weight, capacity, quantity per pack, material composition) stated in the listing form part of the description of the goods under the Sale of Goods Act, 1930, and Products must correspond with that description.

5.3. Availability. All Products are subject to availability. Stock indicators such as “In Stock”, “Low Stock” or a stock quantity are updated by Sellers and refreshed periodically; they are indicative and not a guarantee. If a Product in your Order is unavailable after you have placed the Order, we or the Seller will contact you promptly to offer, at your choice: a suitable replacement; partial delivery with a proportionate refund; or a full refund of the unavailable item in accordance with the Return & Refund Policy and the Digital Commerce Guidelines.

5.4. Pricing or listing errors. Obvious pricing or description errors (for example, a television listed at ৳10 due to a typographical error, or a listing that mixes the images of one product with the specifications of another) do not bind the Seller or Singair Mart. If an Order is placed against an obviously erroneous listing, we may cancel the affected item, notify you promptly, and refund any amount paid for it.

5.5. Compatibility and suitability. Where a Product’s suitability depends on your own equipment, measurements or requirements (for example, spare parts, chargers, clothing sizes, or paint quantities), you are responsible for verifying compatibility using the listing information and, where needed, the Product Q&A feature before ordering. Sizing charts and compatibility tables provided by the Seller form part of the listing.

5.6. Age-restricted and regulated items. Certain categories may be subject to legal purchase restrictions or documentation requirements under Applicable Law. Such requirements are stated on the listing, and by ordering you confirm that you meet them. Items prohibited from sale altogether are addressed in the Prohibited & Restricted Products Policy.

6. Pricing, Taxes, Charges and Invoicing

6.1. All prices on the Platform are quoted in Bangladeshi Taka (৳ / BDT) and, unless expressly stated otherwise on the Product page or at checkout, are inclusive of applicable Value Added Tax under the Value Added Tax and Supplementary Duty Act, 2012. Delivery charges, where applicable, are calculated and shown separately at checkout before you confirm the Order, based on your selected Delivery Area, the Sellers involved and the product categories in your cart.

6.2. Sellers set the prices of their own Products. Promotional prices, strike-through “regular” prices and percentage-saving badges reflect the Seller’s previous or list price. We require Sellers to use genuine reference prices; misleading price comparisons and false discount claims are offences under the Consumer Rights Protection Act, 2009 and may be reported to us at support@singairmart.com and to the DNCRP.

6.3. Invoices. A digital order summary is provided on the order-received page and by email. A printable invoice identifying the Seller, the Products, unit prices, quantities, delivery charge, discounts and total is available from your account or on request. Sellers that are VAT-registered are responsible for issuing VAT-compliant invoices (Mushak-6.3 or as applicable) where the law requires, and for remitting VAT and any other taxes on their sales.

6.4. Prices, delivery charges, free-delivery thresholds (currently free delivery on qualifying orders over ৳1,000, as shown on the Platform) and promotional campaigns may change at any time, but changes do not affect Orders already confirmed.

6.5. No hidden charges are applied: the amount displayed on the checkout summary — Product subtotal, any discount, and the delivery charge — is the full amount payable for the Order. Any cash-handling, COD or payment-gateway convenience fee, if ever introduced, will be displayed at checkout before you place the Order.

7. Order Placement, Contract Formation and Cancellation Before Dispatch

7.1. The checkout requests only the information necessary to fulfil your Order: your full name, phone number, email address, Delivery Area and full address. By submitting an Order you make a binding offer to purchase the Products in your cart at the prices and delivery charge shown.

7.2. Our order confirmation (on-screen and by email, including your personal Tracking Link) acknowledges receipt of your offer. The contract of sale for each item is concluded when the relevant Seller (or Singair Mart, for its own Products) confirms or dispatches that item. Until dispatch, your Order status is visible on your tracking page as “Order Placed” or “Confirmed”.

7.3. We may decline or cancel an Order, in whole or in part, before dispatch where: the Product is unavailable; the listing contained an obvious error; the Order appears fraudulent or was placed by automated means; the payment could not be verified; the delivery address is outside our service areas or cannot be safely served; the quantity ordered indicates commercial resale contrary to a per-customer campaign limit; or the Buyer has repeatedly refused COD parcels without cause. In each case any amount already paid for the cancelled items will be refunded in accordance with clause 11 and the Return & Refund Policy, and we will notify you of the reason.

7.4. Buyer cancellation. You may request cancellation of an Order or of individual items at any time before dispatch, free of charge, by contacting customer service or using the tools in your account. Once an item is marked “Shipped”, cancellation converts into a return request under the Return & Refund Policy (or a refusal at the door for COD parcels, which we ask you to use only for genuine cause).

7.5. Quantity limits. We may impose per-customer quantity limits on campaign items to keep promotions fair. Orders exceeding a published limit may be reduced to the limit or cancelled.

8. Payment Methods, Verification and Anti-Fraud

8.1. The Platform currently supports Cash on Delivery and may support digital payment methods such as bKash, Nagad, Rocket, debit/credit cards and other channels as displayed at checkout from time to time. The payment methods available for a specific Order are those shown at checkout for that Order; availability may vary by Order value, Delivery Area, Product category or account history.

8.2. Cash on Delivery. For COD Orders you must pay the full invoiced amount in cash (or such digital alternative as the Rider accepts) at the time of delivery. Please keep the exact amount ready; Riders may carry limited change. Unless the Platform or the Seller expressly offers open-box inspection at delivery, payment is due on handover of the parcel; your statutory return and refund rights are unaffected by payment. Refusal to pay for a delivered COD parcel without a lawful reason may lead to suspension of COD as a payment option for your Account, and repeated abuse may lead to Account suspension under clause 23.

8.3. Digital payments. Where prepayment methods are offered, payment processing is performed by licensed payment service providers and MFS operators regulated by Bangladesh Bank. We do not store your full card number, card verification code, PIN or wallet credentials on our servers. Payment confirmation is required before dispatch of prepaid Orders. If a prepaid amount is debited but the Order is not recorded, contact customer service with the transaction ID; unreconciled amounts are refunded to the source channel.

8.4. In compliance with the Digital Commerce Guidelines, where advance payment is collected, the prescribed delivery timelines apply and, where required, funds are settled through the escrow or payment-intermediation arrangements prescribed by Bangladesh Bank, releasing payment to the Seller only after delivery confirmation.

8.5. Fraud screening and AML. We may screen Orders and payments for fraud, may request additional verification (such as confirming an OTP or order details by phone), and may cancel Orders that fail verification. We comply with the Money Laundering Prevention Act, 2012 and may report suspicious transactions to the competent authorities. You must not use the Platform to launder money, structure payments, or transact using instruments you are not authorised to use.

8.6. Chargebacks. If you dispute a card or wallet charge with your bank or MFS for an Order you in fact received and accepted, we may contest the chargeback with delivery evidence, suspend your Account pending resolution, and recover amounts owed. Genuine payment disputes should first be raised with our customer service, which is usually the fastest route to a refund.

9. Delivery, Tracking and Receipt of Parcels

9.1. Delivery charges are calculated at checkout based on your selected Delivery Area and, where applicable, per Seller and per product category, as shown before you confirm the Order. Orders whose qualifying subtotal meets the free-delivery threshold displayed on the Platform receive free delivery.

9.2. Estimated delivery times are shown on the Platform and on your tracking page. Consistent with the Digital Commerce Guidelines, where payment has been made in advance, Products located in the same city are to be delivered within five (5) Working Days and Products located elsewhere in Bangladesh within ten (10) Working Days of payment, unless a longer period is expressly agreed at the time of order. COD Orders are dispatched promptly after confirmation. Estimated dates are made in good faith and may be affected by events outside our control (see clause 24).

9.3. Tracking. Every Order has a personal tracking page showing its live status (Order Placed, Confirmed, Shipped, Out for Delivery, Delivered), the assigned Rider’s name, photo, phone number and vehicle where applicable, and the estimated delivery time. Your Tracking Link is included in your order emails; guests may also track at the “Track Your Order” page using the Order ID and billing email. Keep your Tracking Link private, as anyone holding the link can view the delivery status and address area of that Order.

9.4. Receipt. Delivery is made to the address stated on the Order. You or an authorised adult recipient should be available to receive the parcel; the Rider may require the recipient’s name and Order ID. On delivery, check the parcel’s outer condition before signing or paying. If the outer packaging is visibly damaged, tampered with or leaking, you may refuse the parcel and note the reason with the Rider — such refusals are treated as delivery-failure returns at no cost to you. Detailed procedures, including redelivery attempts and holding periods, are set out in the Shipping & Delivery Policy, which forms part of these Terms.

9.5. Risk in the Products passes to you on delivery. Title to prepaid Products passes on the later of payment and delivery; title to COD Products passes on payment at delivery.

10. Warranties and After-Sales Service

10.1. Where a Product page states a brand (manufacturer) warranty, warranty service is provided by the brand or its authorised service network in Bangladesh in accordance with the brand’s warranty card and conditions. Keep the invoice and warranty card; they are normally required for claims.

10.2. Where a Product page states a Seller warranty, the Seller provides repair, replacement or refund as described in the listing for the stated period. Warranty claims may be initiated through customer service or the Seller’s store page, and Singair Mart will assist in coordinating the claim.

10.3. Warranties do not normally cover damage caused by misuse, unauthorised repair, liquid ingress (unless rated), electrical surges beyond specification, normal wear and tear, or consumable parts, as stated in the applicable warranty conditions. Statutory rights in respect of goods that were defective at delivery exist independently of any voluntary warranty and are not reduced by this clause.

11. Refund Channels and Timelines

11.1. Where a refund is due under these Terms, the Return & Refund Policy or Applicable Law: refunds of digital payments are made through the same payment channel used for the purchase; COD refunds are made by MFS transfer or such other method as we agree with you. We initiate refunds within the timeline stated in the Return & Refund Policy and, in any event, within the time required by the Digital Commerce Guidelines after the refund is approved.

11.2. Refund of the delivery charge is included where the return or cancellation is caused by the Seller’s fault (wrong, defective, counterfeit or misdescribed item, or non-delivery). Where a return is made for change of mind under a voluntary returns programme, the Return & Refund Policy states which charges are refundable.

11.3. Refund timing at your bank or MFS may add processing days beyond our initiation; we will provide the refund reference on request.

12. Coupons, Vouchers, Campaigns and Promotions

12.1. We and Sellers may from time to time offer coupons, vouchers, flash deals, campaign prices, bundle offers or free-delivery promotions. Each promotion is subject to the conditions published with it, including validity period, minimum basket value, eligible Products or categories, usage limits per customer, stock allocation and combinability with other offers.

12.2. Campaign countdowns shown on the Platform indicate the scheduled end of a promotion; quantities may be limited and a campaign may end early when allocated stock is sold out. Prices return to their normal level when a campaign ends, and items left unpaid in a cart do not retain campaign pricing after the campaign ends.

12.3. Coupons have no cash value, cannot be exchanged for cash, cannot be sold or transferred unless expressly stated, and may be withdrawn or corrected if issued in error. Where an Order paid partly with a coupon is refunded, the refund equals the amount actually paid; coupon value may be re-issued at our discretion.

12.4. Abuse of promotions — including creating multiple accounts, using automated tools or bots, exploiting a technical error, colluding with Sellers to fake transactions, or reselling coupons — is prohibited and may result in cancellation of Orders, forfeiture of coupon value, recovery of losses and Account suspension.

13. Reviews, Ratings, Questions & Answers and Other User Content

13.1. The Platform allows Buyers to post Product reviews, ratings, photos and questions, and allows Sellers to answer questions and respond to reviews. Reviews help other customers; you must only post content that is truthful, based on genuine experience with the Product or Seller, lawful and respectful.

13.2. You must not post content that:

By submitting content you grant Singair Mart a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, adapt, publish, translate and display that content on the Platform and in our marketing, with attribution to your display name. You retain ownership of your content and you warrant that you have the right to grant this licence. You may request deletion of your content, subject to our need to retain records required by law.

13.4. We may moderate, hold for review, edit for formatting, decline to publish, or remove any user content at our discretion, and may suspend the posting privileges of users who repeatedly breach this clause. We are not obliged to monitor user content but act on notices; to report content, contact support@singairmart.com. Questions submitted through the Product Q&A feature may be held for moderation before publication, and answers provided by Sellers reflect the Seller’s knowledge of its own Product.

13.5. Any ideas, suggestions or feedback you voluntarily send us about the Platform may be used by us without restriction or compensation, and you waive any claim in respect of our use of such feedback.

14. Acceptable Use of the Platform

14.1. You agree not to:

14.2. Violations of clause 14.1 may constitute offences under the Information and Communication Technology Act 2006 and the Cyber Security Act 2023, may give rise to civil liability, and will be reported to the competent authorities where appropriate.

14.3. Responsible disclosure. If you discover a security vulnerability in the Platform, please report it privately to support@singairmart.com and allow us reasonable time to remediate before any disclosure. Good-faith security research conducted without harming users, data or service availability will not be treated as a breach of clause 14.1.

15. Sellers, Storefronts and Off-Platform Dealings

15.1. Sellers are admitted to the Platform through an application and verification process, which may include verification of national identity documents, trade licence, TIN/BIN and bank or MFS account details, and must comply with the Seller Terms & Conditions, the Seller Code of Conduct and the Prohibited & Restricted Products Policy. Those documents are available on the Platform and are incorporated into these Terms by reference for Sellers.

15.2. Buyers acknowledge that Sellers are independent businesses. Statements, offers or commitments made by a Seller outside the Platform (for example, through social media, phone calls or messaging apps) are not made on behalf of Singair Mart, and transactions concluded off-Platform — including payments sent directly to a Seller’s personal MFS account — are not covered by the Buyer Protection Policy. For your protection, keep all communication, ordering and payment within the Platform.

15.3. Sellers may operate storefront pages with their own branding, follow buttons, reviews and Q&A. Vacation mode may make a Seller’s Products temporarily unavailable for purchase; existing Orders remain subject to fulfilment or refund.

15.4. Singair Mart earns commissions and fees from Sellers as described in the Seller Terms & Conditions. Commission rates do not change the price you pay as displayed at checkout.

16. Intellectual Property

16.1. The Platform, including its design, layout, source code, database, logos, the “Singair Mart” name and marks, and all content created by us, is owned by or licensed to Singair Mart and protected under the Copyright Act 2000 (as amended), the Trademarks Act 2009 and other Applicable Law. Except for browsing, ordering and printing order documents for personal use, no part of the Platform may be reproduced, distributed, publicly displayed or otherwise exploited without our prior written consent.

16.2. Product content is owned by the respective Sellers or their licensors. You may not copy Sellers’ images or text for use elsewhere without their permission.

16.3. Complaints regarding infringing listings — including counterfeit goods, copied images and unauthorised use of brand names — are handled under our Intellectual Property Policy, which provides a notice-and-takedown procedure for rights holders and a counter-notice procedure for affected Sellers.

17. Privacy and Data Protection

17.1. We collect and process personal data as described in our Privacy Policy, including the contact and delivery details you provide at checkout, order history, customer-service correspondence, and technical data such as cookies and device information (see the Cookie Policy). We use this data to operate the marketplace, fulfil Orders, provide tracking, prevent fraud, comply with legal obligations and, with your consent where required, send you marketing communications such as our newsletter.

17.2. We share Order data with the relevant Seller and with delivery personnel to the extent necessary to fulfil your Order, with payment providers to process payments, and with competent authorities where required by law. We do not sell your personal data.

17.3. We apply reasonable technical and organisational measures to protect personal data, including access controls and encryption in transit. No system is perfectly secure; report suspected data incidents to support@singairmart.com.

17.4. You may request access to, correction of, or deletion of your personal data as described in the Privacy Policy, subject to records we must retain under tax, commercial and consumer-protection law. You may unsubscribe from marketing at any time; transactional messages (order confirmations, delivery updates, security notices) are part of the service and cannot be opted out of while you use the service.

18. Communications and Electronic Notices

18.1. By providing your phone number and email address you consent to receive service communications from us and, for Order fulfilment, from the Seller and the Rider — including order confirmation emails containing your Tracking Link, delivery-status SMS or calls, and requests to coordinate delivery.

18.2. Notices to you may be given by email to the address on your Account or Order, by SMS, or by posting on the Platform, and are deemed received on transmission or posting. Notices to us should be sent to support@singairmart.com or to our office address published on the Contact page and are deemed received on our acknowledgement. Our customer service hours are Saturday to Thursday, 9:00 AM – 10:00 PM (Friday closed), unless stated otherwise on the Contact page.

18.3. You agree that electronic communications and records satisfy any legal requirement that a communication or record be in writing.

19. Third-Party Services and Links

19.1. The Platform may contain links to third-party websites and may integrate third-party services (such as payment gateways, MFS providers, courier or logistics tracking, social login providers, web fonts and analytics). Those services are governed by their own terms and privacy policies. We are not responsible for the content, security or practices of third-party sites and services, and provide links and integrations for convenience only.

19.2. Social login (where offered) authenticates you through the chosen provider; we receive only the profile data necessary to create or link your Account, as described in the Privacy Policy.

20. Platform Availability, Maintenance and Changes

20.1. We aim to keep the Platform available at all times, but access may be suspended temporarily for maintenance, upgrades, security response or circumstances described in clause 24. Where practicable, planned maintenance will be scheduled at low-traffic hours.

20.2. We may add, modify, redesign or discontinue features of the Platform (including payment methods, delivery options, tracking features, comparison, Q&A and campaign formats) at any time. If a change materially reduces your rights in respect of an existing Order, the terms in force when you placed that Order continue to apply to it.

20.3. We are not liable for unavailability of the Platform, except to the extent liability cannot be excluded under Applicable Law.

21. Disclaimers

21.1. The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by Applicable Law, we make no warranty that the Platform will be uninterrupted, error-free, secure or free of viruses, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement in relation to the Platform itself.

21.2. Nothing in these Terms excludes or limits: (a) statutory warranties and conditions applicable to the sale of goods under the Sale of Goods Act 1930; (b) your rights under the Consumer Rights Protection Act 2009; (c) liability for death or personal injury caused by negligence; or (d) liability for fraud or fraudulent misrepresentation. Those rights and liabilities apply in full despite any other clause of these Terms.

21.3. Content on the Platform (including blog articles, buying guides and Q&A answers) is general information, not professional advice. Verify critical information — for example, medical, electrical or dietary suitability — with a qualified professional before relying on it.

22. Limitation of Liability

22.1. Subject to clause 21.2, and to the extent permitted by Applicable Law: (a) Singair Mart’s total aggregate liability to a Buyer arising out of or in connection with an Order shall not exceed the total amount paid or payable by that Buyer for that Order; (b) Singair Mart’s total aggregate liability arising out of use of the Platform other than in connection with an Order shall not exceed ৳10,000; and (c) we shall not be liable for loss of profits, loss of business, loss of goodwill, loss of data, or indirect or consequential loss.

22.2. The primary responsibility for Product quality, authenticity, safety, warranty service and legal compliance rests with the Seller of the Product. This clause does not limit the remedies available to you under the Buyer Protection Policy or Applicable Law against Singair Mart in its role as marketplace operator, and does not limit the Seller’s liability to you.

22.3. You must take reasonable steps to mitigate any loss, including inspecting parcels on delivery and reporting problems within the timelines stated in the Return & Refund Policy.

23. Indemnity

23.1. You agree to indemnify and hold harmless Singair Mart, its owners, employees and agents from and against claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of: (a) your breach of these Terms; (b) your violation of Applicable Law or of the rights of a third party; (c) content you submit to the Platform; or (d) misuse of your Account resulting from your failure to secure your credentials. This clause does not apply to the extent a claim results from our own breach, negligence or wilful misconduct.

24. Force Majeure

24.1. Neither we nor any Seller shall be liable for delay or failure to perform obligations (other than payment obligations already due) caused by events beyond reasonable control, including natural disasters, floods, cyclones, earthquakes, epidemics or pandemics and related government measures, strikes, hartals, blockades, political unrest, fire, war, acts of government or regulators, failures of telecommunications, internet or power infrastructure, disruption of banking or MFS systems, or disruption of transport.

24.2. Performance is suspended for the duration of the event. We will take reasonable steps to notify affected Buyers and to resume performance. If performance of an Order becomes impossible or is delayed beyond a reasonable period, the affected Order may be cancelled by either party with a full refund of amounts paid.

25. Suspension and Termination

25.1. You may stop using the Platform at any time and may request deletion of your Account through customer service, subject to completion of open Orders and our record-keeping obligations under Applicable Law (including tax and commercial record requirements).

25.2. We may suspend or terminate your Account or restrict features (for example, COD availability, coupon use or review posting) if: you materially or repeatedly breach these Terms; we reasonably suspect fraud, money laundering, abuse of promotions or review manipulation; you refuse delivered COD parcels repeatedly without cause; you harass our staff, Riders or Sellers; or we are required to do so by law or by a competent authority. Where practicable we will give you notice and an opportunity to respond before termination, except in cases of fraud, security risk or legal compulsion.

25.3. Termination does not affect accrued rights and obligations, including your obligation to pay for delivered Orders and our obligation to process due refunds. Clauses which by their nature survive termination (including clauses 13.3, 16, 21–23, 26 and 27) continue to apply.

26. Consumer Complaints, Grievance Handling and DNCRP

26.1. We maintain a customer-service team to resolve complaints. Contact us first at support@singairmart.com, by phone at +880 1761-234567, or through the Contact page. We aim to acknowledge complaints within 72 hours and to resolve delivery and refund complaints within the timelines stated in the relevant Policy. Keep your Order ID ready to help us assist you quickly.

26.2. Our complaint process is: (1) registration of your complaint with a reference; (2) investigation with the Seller, Rider or payment provider as relevant; (3) proposed resolution (redelivery, replacement, repair, refund or other remedy); and (4) escalation review on request if you are dissatisfied with the proposed resolution.

26.3. If you remain dissatisfied, you may lodge a complaint with the Directorate of National Consumer Rights Protection (DNCRP) under the Consumer Rights Protection Act 2009 — including through the national consumer complaints hotline 16121 or the DNCRP’s online complaint system — within the statutory time limit (currently thirty days from the cause of action arising, as prescribed). Nothing in these Terms restricts your right to complain to the DNCRP, the Bangladesh Competition Commission, Bangladesh Bank (for payment issues) or any other competent authority.

27. Governing Law and Dispute Resolution

27.1. These Terms and every Order are governed by the laws of the People’s Republic of Bangladesh.

27.2. The parties shall first attempt to resolve any dispute amicably through the process in clause 26. If the dispute is not resolved within thirty (30) days, either party may refer it: (a) in the case of a consumer dispute, to the DNCRP or the competent court; or (b) in other cases, to arbitration seated in Dhaka under the Arbitration Act 2001, before a sole arbitrator appointed by agreement of the parties (failing which, as provided in that Act), conducted in Bangla or English. Subject to the foregoing, the courts of Bangladesh have jurisdiction.

27.3. Nothing in this clause prevents either party from seeking urgent injunctive relief from a competent court, and nothing limits a consumer’s statutory forum rights.

28. Amendments, Severability and Other General Provisions

28.1. Amendments. We may amend these Terms and our Policies from time to time to reflect changes in law, our services or business practice. The “Last updated” date at the top will change, and material changes will be announced on the Platform or by email a reasonable time before they take effect. Amendments apply prospectively from their effective date and do not affect Orders already placed.

28.2. Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision shall be deemed modified to the minimum extent necessary to make it valid and to give effect to its original commercial intent.

28.3. No waiver. Failure or delay in enforcing a provision is not a waiver of the right to enforce it later, and a waiver on one occasion is not a waiver on any other occasion.

28.4. Assignment. You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign or transfer our rights and obligations to an affiliate or to a successor of our business, with notice to you and without reducing your rights.

28.5. Entire agreement. These Terms, together with the Policies and the details of your Order, constitute the entire agreement between you and Singair Mart concerning the Platform and supersede prior communications on that subject. You confirm that you have not relied on any statement not recorded in these Terms or on the Platform.

28.6. Relationship of the parties. Nothing in these Terms creates any agency, partnership, employment or joint venture between you and Singair Mart, or between Singair Mart and any Seller beyond the marketplace relationship described here. Riders act as delivery agents for the limited purpose of delivering parcels and collecting COD payments against Orders.

28.7. Third-party rights. Except as expressly stated (for example, protections extended to our employees and agents under clause 23), these Terms do not confer rights on any third party.

29. Category-Specific Terms

29.1. Electronics and appliances. Check voltage, plug type and regional compatibility stated in the listing before ordering. Retain original packaging, accessories, manuals and the invoice during the warranty period; warranty claims usually require them. Serial numbers may be recorded at dispatch to prevent fraudulent swaps, and returned electronics are verified against the dispatched serial number before a refund is approved.

29.2. Groceries, food and perishables. Perishable items are dispatched with a reasonable remaining shelf life and must be inspected on delivery. Because of their nature, perishables are excluded from change-of-mind returns; complaints about spoiled, expired or damaged food items must be raised within the short reporting window stated in the Return & Refund Policy, with photographs where possible. Food Products must comply with the Safe Food Act, 2013 and applicable BSTI standards, which is the responsibility of the Seller.

29.3. Fashion, clothing and footwear. Size charts on the listing are the Seller’s measurements for that Product; when in doubt, use the Q&A feature before ordering. Items returned under a voluntary returns programme must be unworn, unwashed, undamaged and returned with original tags and packaging, except where the return is due to a defect or misdescription.

29.4. Fragile items. Items marked fragile (glassware, ceramics, mirrors) must be inspected at delivery where open-box inspection is offered. Transit damage must be reported within the window stated in the Return & Refund Policy, ideally with photographs of the parcel and the item as received.

29.5. Health, beauty and personal care. For hygiene reasons, cosmetics, skincare, innerwear and similar personal items cannot be returned once opened or seal-broken, unless defective or not as described. Check ingredients and expiry information on the listing; discontinue use and seek medical advice if irritation occurs, and report suspected non-genuine items to us immediately.

29.6. Books and media. Books may be returned under a voluntary returns programme only in unread, undamaged condition. Counterfeit or pirated print is prohibited on the Platform; suspected pirated copies should be reported under the Intellectual Property Policy.

30. Order Status Glossary

30.1. The tracking page uses the following statuses: Order Placed — your Order has been received and is awaiting confirmation; Confirmed — the Seller has confirmed availability and is preparing your items; Shipped — your parcel has been handed to a Rider or courier and is on its way; Out for Delivery — the Rider is in your area and will attempt delivery shortly; Delivered — the parcel has been handed over at the delivery address. Cancelled, failed or refunded Orders display a corresponding notice instead of the forward timeline.

30.2. Status timestamps shown on the tracking page reflect the time the status was recorded in our systems and may differ by a short interval from the physical event.

31. Doorstep Conduct and COD Protocol

31.1. Riders will attempt to contact you by phone on approach. Please keep your phone reachable during the estimated delivery window; two unreachable attempts may result in the parcel being returned as a failed delivery under the Shipping & Delivery Policy.

31.2. At the doorstep: verify that the parcel label bears your name and Order ID; check the outer packaging for damage or tampering before paying or signing; pay the exact invoiced COD amount (the amount on your order confirmation — Riders are not authorised to demand more); and collect your receipt where provided. If anything is inconsistent — a different amount demanded, a broken seal, a wrong name — decline politely and contact customer service immediately.

31.3. Riders are instructed to behave courteously, to respect your privacy, and never to request payment to a personal MFS number for an Order. Report any deviation to support@singairmart.com with your Order ID; verified complaints result in corrective action.

31.4. Equally, we expect courteous treatment of Riders. Abuse, assault or unlawful detention of delivery personnel will result in Account termination and may be reported to law-enforcement authorities.

32. Bulk, Wholesale and Institutional Orders

32.1. The Platform is designed for retail purchases. Orders of unusual quantity may be flagged for confirmation, may exceed published campaign limits (and be reduced accordingly), or may require a separate wholesale arrangement with the Seller. Contact customer service for institutional or bulk purchasing, GST/VAT documentation needs, or corporate invoicing.

32.2. Products purchased on the Platform are for end use and may not be resold in a manner that misrepresents the reseller as Singair Mart or an authorised partner, or that breaches a brand’s selective-distribution rights under Applicable Law.

33. Records, Documents and Data Retention

33.1. We retain Order records, invoices, delivery confirmations, refund records and related correspondence for the periods required by Applicable Law, including tax law and the Digital Commerce Guidelines, and for the defence of legal claims. You may download or request copies of your own order documents at any time while your Account is active and for a reasonable period afterwards.

33.2. Where your Account is deleted, transactional records that we are legally required to keep are retained in restricted archives and are not used for marketing.

33.3. Screenshots or copies of listings made by Buyers are for personal reference; the listing content as recorded in our systems at the time of the Order is the authoritative description of what was offered.

34. Accessibility and Support

34.1. We aim to keep the Platform usable across common devices, browsers and connection speeds available in Bangladesh, including a mobile-optimised experience with simplified navigation. If you encounter an accessibility barrier, tell us at support@singairmart.com and we will try to assist you, including by taking your order or complaint over the phone during service hours.

34.2. Guidance content in the Help Center is provided to assist you and does not replace these Terms; where Help Center guidance and these Terms conflict, these Terms prevail.
