Singair Mart respects intellectual property rights and expects the same of every Seller and user. This Intellectual Property Policy (“IP Policy”) explains what content is protected, what conduct is prohibited, and how rights holders can report infringement through our notice-and-takedown procedure. It forms part of our Terms & Conditions and the Seller Terms & Conditions.

1. Legal Framework

This IP Policy operates under the laws of Bangladesh, including the Copyright Act 2000 (as amended), the Trademarks Act 2009, the Patents Act 2022, the Designs Act, the Penal Code 1860 (in respect of counterfeiting), the Special Powers Act 1974 and the Consumer Rights Protection Act 2009 (in respect of deceptively marketed goods), together with Bangladesh’s obligations under the TRIPS Agreement.

2. Platform Intellectual Property

2.1. The “Singair Mart” name, logo, monogram, site design, source code, database and original content are owned by or licensed to Singair Mart. You may not use our marks — including in seller store names, advertising, domain names or social media handles — in a way that suggests endorsement or affiliation without our written permission.

2.2. Browsing, ordering, printing order documents and sharing product links are permitted uses. Copying our catalogue at scale, mirroring the Platform, or extracting the database is prohibited.

3. Seller Content and Responsibilities

3.1. Sellers own (or must be licensed to use) the content they upload — product photos, descriptions, brand names, logos and videos — and warrant that their listings and products do not infringe any third party’s rights.

4. Reporting Infringement (Notice and Takedown)

4.1. Rights holders or their authorised agents may report infringing listings by emailing support@singairmart.com with the subject “IP Complaint”, including:

4.2. We acknowledge complete notices within 72 hours and, where the notice is facially valid, remove or suppress the listing pending investigation — normally within 5 working days of acknowledgement, sooner for clear counterfeits.

4.3. Incomplete notices will be returned with a request for the missing information. Submitting knowingly false infringement claims may result in liability to the affected Seller and loss of access to this procedure.

5. Seller Counter-Notice

5.1. A Seller whose listing is removed will be notified with the reason and the complainant’s claim (excluding confidential details). The Seller may submit a counter-notice with evidence of authorisation, genuine sourcing (invoices, distributor agreements) or ownership of the content.

5.2. If the counter-notice credibly rebuts the claim and the complainant does not initiate legal proceedings within 10 working days of being informed, we may restore the listing. Where the dispute is genuinely contested, we may keep the listing down and direct the parties to resolve the matter legally; we are not the judge of contested IP ownership.

6. Repeat Infringer Policy

6.1. We track IP complaints per Seller. Confirmed infringements result in escalating penalties under the Seller Code of Conduct — from listing removal and campaign exclusion to store suspension. Sellers with repeated confirmed counterfeit findings are terminated, their related proceeds may be withheld to fund customer refunds, and cases may be referred to law-enforcement authorities.

7. Buyers and User Content

7.1. Buyers must not upload content in reviews or Q&A that infringes others’ rights (for example, copying professional photographs into reviews). Buyers who receive suspected counterfeit goods are protected by the Buyer Protection Policy and are encouraged to report the listing.

7.2. By posting content, users grant the licence described in the Terms & Conditions; that licence does not transfer ownership.
