This Prohibited & Restricted Products Policy lists the items that may never be listed on Singair Mart (“Prohibited Products”) and the items that may be listed only under conditions (“Restricted Products”). It applies to every Seller and every listing. Listing a Prohibited Product, or a Restricted Product without meeting its conditions, is a serious violation that may result in immediate listing removal, order cancellation, account suspension or termination, forfeiture of related proceeds, and reporting to law-enforcement or regulatory authorities. Buyers who encounter such items should report them to support@singairmart.com.

1. Legal Basis

This Policy implements the laws of Bangladesh, including the Penal Code 1860, the Special Powers Act 1974, the Narcotics Control Act 2018, the Arms Act 1878, the Explosive Substances Act 1908, the Drugs and Cosmetics Act 2023, the Safe Food Act 2013, the Wildlife (Conservation and Security) Act 2012, the Bangladesh Standards and Testing Institution Act 2018, the Import Policy Order in force, the Trademarks Act 2009, the Copyright Act 2000 (as amended), the Cyber Security Act 2023 and the Digital Commerce Operation Guidelines 2021, as well as marketplace safety standards.

2. Prohibited Products (Never Allowed)

• Illegal drugs and precursors: narcotics, psychotropic substances, cannabis, yaba, controlled precursor chemicals, and drug paraphernalia (Narcotics Control Act 2018).
• Weapons and explosives: firearms, ammunition, air guns requiring licence, tasers, knuckle-dusters and other offensive weapons; explosives, fireworks and their precursors (Arms Act 1878; Explosive Substances Act 1908).
• Counterfeit and pirated goods: fake branded products, replicas presented as genuine, counterfeit currency and stamps, pirated software, movies, music and books (Trademarks Act 2009; Copyright Act; Penal Code).
• Stolen or smuggled goods, and goods whose import is banned under the Import Policy Order.
• Prescription-only medicines, unregistered drugs and medical devices not approved by the Directorate General of Drug Administration; expired medicines or foods in all cases.
• Alcohol, tobacco, cigarettes, e-cigarettes, vaping products and nicotine substances, whose online sale/advertising is restricted or prohibited under Bangladeshi law and marketplace policy.
• Adult and obscene material: pornography and obscene content of any kind (Penal Code; Cyber Security Act 2023).
• Gambling items and lottery tickets, including devices or services primarily for unlawful betting.
• Wildlife and animal products: protected species, ivory, tortoise shell, wild bird trade, and products of endangered species (Wildlife Act 2012); live animals except where expressly permitted by us in writing under welfare conditions.
• Human organs, blood, tissues and remains.
• Hazardous chemicals and poisons sold outside lawful licensing — acids whose retail sale is restricted under the Acid Control Act 2002, mercury, pesticides without registration, ozone-depleting substances.
• Surveillance and interception equipment prohibited for civilian use, GSM jammers, and devices for stealing data (skimmers).
• Government property and documents: uniforms, official IDs, NID cards, passports, academic certificates (genuine or forged), SIM cards registered to others.
• Financial instruments: shares, securities, cryptocurrencies and crypto-mining contracts (restricted by Bangladesh Bank), loyalty points, and recharge/balance schemes structured as money-service business.
• Malicious software and hacking tools marketed for unauthorised access (Cyber Security Act 2023).
• Offensive or hateful material that incites violence or hatred against any group, or content that hurts religious sentiment in violation of law.
• Recalled or banned consumer products, including items failing mandatory BSTI certification where required.

3. Restricted Products (Allowed Only With Conditions)

• Over-the-counter healthcare items, supplements and herbal products: must be DGDA/BSTI-compliant where applicable, within expiry, with visible batch and expiry information in the listing.
• Cosmetics and skincare: must be genuine, labelled per the Drugs and Cosmetics Act 2023 and BSTI rules; imported items must carry importer information.
• Packaged food and beverages: must comply with the Safe Food Act 2013 and BSTI mandatory certification where applicable; listings must state expiry/shelf-life; perishables must meet the handling standards of the Shipping & Delivery Policy.
• Baby food and infant formula: compliant with the Breast-Milk Substitutes Act 2013 — no promotional claims discouraging breastfeeding; formula may be listed informationally as permitted by law.
• Electronics with wireless functions: must comply with BTRC type-approval requirements where applicable; IMEI-bearing devices must be genuine, non-cloned and legally imported.
• Knives and cutting tools: kitchen and utility tools only; combat-style knives are prohibited.
• Chemicals and cleaning agents: retail consumer packs only, properly labelled with safety warnings; industrial chemicals require our prior written approval and proof of licensing.
• Seeds, plants and fertilisers: must comply with agricultural regulations and be accurately described.
• Second-hand / refurbished goods: must be clearly labelled as used or refurbished with honest condition grading and warranty statement; presenting used goods as new is a deceptive practice under the Consumer Rights Protection Act 2009.
• Religious items and books: permitted with respectful, accurate description; sectarian hate material is prohibited.
• Event tickets and vouchers: only where the Seller is authorised to distribute them and the listing states validity terms.

4. Listing Standards for Restricted Products

4.1. For every Restricted Product, the Seller must hold and, on request, produce the relevant licence, approval, import document or authorisation, and must reflect all legally required information (ingredients, warnings, expiry, certification marks) in the listing and on the physical product.

4.2. We may require pre-approval for specific categories, delist items pending verification, and test-purchase products to check compliance and authenticity.

5. Enforcement

5.1. Depending on severity and history, enforcement measures include: listing removal; category restriction; campaign exclusion; withholding of related sale proceeds; account suspension or termination under the Seller Terms & Conditions; and notification to the DNCRP, police or other competent authorities where the law requires or permits.

5.2. Buyers who received a prohibited, counterfeit or non-compliant item are entitled to remedies under the Return & Refund Policy and the Buyer Protection Policy, funded by the responsible Seller.

6. Reporting

6.1. To report a suspicious listing, email support@singairmart.com with the product link and the reason. Rights holders should use the notice procedure in the Intellectual Property Policy. We review reports promptly and keep reporter identity confidential to the extent permitted by law.

7. Updates

7.1. This Policy is updated as laws and regulator directions change. The list above is indicative, not exhaustive: anything whose sale, possession or advertisement is illegal in Bangladesh is prohibited on Singair Mart even if not named here, and we may decline any product category at our discretion for safety or reputational reasons.
